Terms and Conditions

Please read these terms and conditions carefully before ordering any Products from our online website (www.amgbathrooms.com). You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.

If you do not agree to these terms, you may not use this site. Mission Corporation (UK) Ltd T/A Aquaflo Mission Group (AMG) reserves the right, at any time, to modify, alter, or update these terms of use, and you agree to be bound by such modifications, alterations, or updates on subsequent visits.

1.BUYING

1.1 To make a purchase, browse our catalogue and click on any items that you wish to buy to add to your shopping cart. When you have selected all the items you wish to buy, click on "CHECKOUT" to pay for you goods.

1.2 Your credit card payment is taken and processed securely. All credit card numbers are encrypted when the order is placed. They are not held in clear text on any web site, nor are they ever seen by amgbathrooms.com.

2.CONDITIONS

2.1 In these terms and conditions:

  • "goods" means the goods (including any installment of the goods or any parts for them) which the Supplier is to supply in accordance with these terms and conditions
  • "Supplier" means Mission Corporation (UK) Ltd T/A Aquaflo Mission Group.
  • "Website" means www.amgbathrooms.com

3. ORDERING OF GOODS

3.1 We try wherever possible to deliver goods from stock, however this cannot be always guaranteed. If the product selected is required by a specific date, please contact us by email on stockcheck@amgbathrooms.com before placing and paying for your order.

3.2 On completion of placing your order online, you will receive an email acknowledgement (to the email address provided when placing the order). Please note that this does not mean that your order has been accepted by us. The contract between us is formed when the goods are dispatched. We (AMG) reserve the right, at any time prior to acceptance, to refuse any order or any part of an order.

3.3 If goods are ordered over a weekend, Bank Holiday or after midday the order date is taken as the next working date.

3.4 If any goods are priced in error, AMG will not be bound to honour incorrect prices.

4. CANCELLATION OF ORDER (prior to shipment)

4.1 To cancel your order please email cancellations@amgbathrooms.com you will receive a confirmation back to you confirming the cancellation if agreed.

4.2 If the order has already been dispatched from the warehouse, you will be unable to cancel your order. In these circumstances you will have to returns the goods yourself, as stated under the Returns Policy.

4.3 Bespoke items, such as Made to Measure and Special Order items may not be cancelled after ordering.

4.4 Refunds will be issued as soon as possible and in any case, within 30 days

5. DELIVERY OF GOODS

5.1 We aim to deliver most products from stock within 7 working days, however this cannot always be guaranteed. If there is a delay in the delivery we will notify you by email accordingly (see 3.1 before placing your order). All delivery dates given are provisional only.

5.2 Certain delivery point postcodes will incur a higher carriage charge than stipulated above (i.e. areas of Scotland/Ireland/N.Ireland/Channel Islands/Outside of UK) and we will contact you to advise further carriage charges if applicable.

5.3 The delivery of goods to you is deemed to be a separate contract for services, distinct from your contract to purchase the goods.

5.4 For goods which are shipped on a pallet, the goods will be delivered as close as possible to your front door. The delivery drivers are not insured to take their vehicles off the public highway. If your property is unreachable for any reason, such as access being on a private road, up a flight of stairs (such as flats), or any other obstruction (inc. Narrow streets), delivery will be made as near to your property as possible.

5.5 The refusal of a delivery due to examples in 4.2 and 5.5, will lead to the actual delivery costs and collection fees being charged.

5.6 The delivery will be made by a single driver, so please ensure at least one able bodied person is available to assist the driver with the carrying.

5.7 The driver is NOT insured to take the goods inside your property. So therefore if the goods ordered are of a heavy or bulky nature, it is strongly recommended that at least two able bodied persons are available to get the goods inside the property.

5.8 Delivery dates are approximate and no liability whatsoever is accepted in respect of late deliveries. Please do not arrange fitting of the items until they have been delivered and checked for discrepancies/damages.

6. DAMAGES and SHORTAGES

6.1 Small items that arrive by courier, you agree to open all boxes, thoroughly check the goods for damage and notify us via email to customerservices@amgbathrooms.com if there is damage/shortage within 24 hours of delivery. If the packaging of the item appears damaged on delivery, you must write "damaged" on the delivery note. The courier drivers will not wait whilst you check the product.

6.2 For items which are dispatched using a pallet service you agree to check the goods for damage. Any products damaged in transit must be noted at the time of delivery and documented on the delivery note. We will not accept claims for products damaged in transit that were signed for as being in good condition or as unchecked. If you have purchased a large number of items, it is advisable that you have another able bodied person to help in checking of the goods.

6.3 If part of an order is damaged on delivery, accept all of the order but make a note on the delivery note which item(s) are damaged. Notify us within 24 hours and we will arrange collection of the damaged item(s) and delivery of the replacement item(s). Do not refuse delivery unless all items are damaged.

6.4 If you appoint someone else to receive and sign for the goods on your behalf, you agree to advise them that the goods must be checked and you accept full responsibility for any damage or losses if they sign on your behalf.

6.5 AMG will not consider any claims for damage or shortages 24 hours after delivery.

6.6 From the time of receipted delivery of the goods. Any loss or damage to the goods shall be at your own risk.

6.7 If a bespoke item arrives damaged, a replacement will be dispatched once manufactured.

7. RETURNS POLICY - Non-Faulty Goods

7.1 If you do not require a product when you receive it, you may cancel your order at any time until the end of the seventh working day after the day on which you receive your goods. This is known as the "cooling-off period".

7.2 To cancel your order, please email cutomersevices@amgbathrooms.com and request an AMG Returns Form which must be completed and attached to any product for return. In your email you must clearly state the reasons for wishing to return the product(s).

7.3 If you cancel your order under these provisions, then you will be responsible for returning the goods to us in a good condition and at your own cost. You have a responsibility of care, by law to ensure that the goods are received by us in a good condition and unused. If received damaged or used, credit may be refused.

7.4 AMG reserves the right to not accept any products where the packaging is damaged or defaced and therefore unsuitable for resale.

7.5 Due to hygiene concerns some of our products can not be returned, once opened.

7.6 Return of goods after the 7 working day "cooling-off period", if accepted will incur a 25% restocking and administration charge. We may refuse goods to be returned without good reason.

7.7 Bespoke items can not be returned.

7.8 If we are unable to accept your return(s), we will contact you to arrange the re-delivery of your returned item. A re-delivery charge may be applied in this case.

8. RETURNS POLICY - Faulty Goods

This applies to goods which develop a fault after installation and not transit damage (please see section 6, for damaged goods in transit).

8.1 All goods supplied by AMG come with a 12 month manufacturer’s guarantee. When Products are stated as having longer guarantees, these guarantees are covered by the Manufacturer and not AMG.

8.2 In the event of faulty goods being returned at the expense of the customer, AMG will refund reasonable postage costs.

8.3 All returned faulty goods are tested by the manufacturer, and if the item is not faulty the product value will be refunded minus the cost of the testing process.

8.4 In some cases the Manufacturers offer a service/breakdown engineer service who will visit your property to repair or replace the faulty item. If the fault is not causing any damage, please do not remove the installed item as this could void your guarantee. We find that it is quicker if you contact the manufacturer directly, to arrange a call from an engineer in the case of a product developing a fault.

9. DELIVERY OF GOODS, SERVICE OF CONTRACT

9.1 By placing an order for delivery during the checkout stage, you are agreeing to enter into a separate delivery service contract.

9.2 Once the items have been dispatched from our warehouse the delivery service contract can not be cancelled and is chargeable.

9.3 The refusal of a delivery, will lead to the actual delivery costs and collection fees being charged. Please Note that the actual costs will be considerably higher than the standard price you were originally charged due to the return voyage.

9.4 If an order cannot be accepted on the day of delivery, then a re-delivery charge may be applicable. This cost would then be Bourne by the purchaser

9.5 Do not refuse delivery of a pallet unless all items are damaged (see 6.3), as you will be charged the actual delivery cost and collection fee.

10. WARRANTY

10.1 This warranty does not apply to any defect in the goods arising from fair wear and tear, willful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Suppliers instructions, misuse, or any alteration or repair carried out without the Suppliers approval.

12. WRITTEN COMMUNICATIONS

12.1 By law we have to provide written information to you regarding your rights as a consumer. When using our site, you are accepting that we can send this information electronically to you (on the email you supplied when placing your order) and accept that these contracts and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

13. EXTERNAL SITES

13.1 AMG is not responsible for the availability of, or content located on or through any external site linked to amgbathrooms.com nor for any transactions between you and such sites.

13.2 If you have any concerns regarding 3rd party sites linked to amgbathrooms.com, please notify us as soon as possible and an investigation will be carried out.

14. Disclaimers and Limitations – Liability for amgbathrooms.com

14.1 Without prejudice to statutory rights afforded to purchasers of products, the information and materials contained in this site, including, without limitation, text, graphics, and links, are provided on an "as is" basis with no warranty, and in particular amgbathrooms.com does not represent or warrant that the information accessible via this site is accurate, complete or current, or that use of this site is free of risk of viruses or other damage. Price and availability information is subject to change without notice. Products purchased from amgbathrooms.com and related services which are provided by amgbathrooms.com, are warranted within accordance with law, and nothing herein is to be taken to exclude or restrict any rights, which applicable law grants to consumers in respect of such products or services.
